Terms and Conditions
1. GENERAL
These detailed General Conditions of Sale (hereinafter referred to as "Terms and Conditions") exclusively determine the contractual relations between all customers and respective users of the Website www.acquazmc.com and the distribution company ACQUA ZMC, Distribuições, Lda, with NIF 507719840, whose headquarters are located at Rua do Corvo, 455, 4410-439 Arcozelo – Vila Nova de Gaia, hereinafter referred to as ACQUA ZMC.
The general terms and conditions of sale are the only ones that apply and replace all other terms and conditions, except by prior agreement. ACQUA ZMC may occasionally modify certain provisions of its general terms and conditions, and it is also necessary for these to be reread each time you visit the Website. We therefore consider that when a specific order is submitted, the customer is automatically accepting our general terms and conditions of sale.
2. ORDER
Register in the customer area and follow the necessary steps presented.
Browse the online store by choosing the category that suits you best, selecting the products you are interested in, their respective quantities and following the instructions provided.
Orders are placed through the online store. If you prefer, you can send your orders via our email encomendas@acquahigiene.com , providing not only the items and quantities, but also the tax details, delivery address and how you wish to make payment.
The processing of the respective orders is subject to acceptance by ACQUA ZMC.
Estimated delivery time will be between 2 to 5 working days, depending on the region, unless out of stock.
In the event of a stock shortage after submitting and eventually making payment for the order, our services will contact you to inform you of the new delivery date, offering the possibility of a refund if the customer does not wish to wait for the arrival of the material in question.
In the event that only part of the order is unavailable, ACQUA ZMC undertakes to send the remaining products in stock at the time of your order, not charging shipping costs when sending the remaining material that was delayed, that is, if the initial order is exempt from shipping costs.
Delivery times are indicative and therefore to be considered valid when there are no physical or structural impediments (for example: incorrect addresses or force majeure setbacks, among others).
If you wish to make any changes to your order after it has been submitted, you must contact us, only and exclusively by email ( encomendas@acquahigiene.com ) to make the respective change, which can only be carried out if the order is still physically at our facilities.

Whenever necessary, you can request the respective technical data sheets for the items purchased ( acqua@grupozmc.com ), particularly for chemical products, as well as any other products.
The images that illustrate the products do not enter into the contractual field and do not represent any commitment on the part of ACQUA ZMC; they may not even correspond exactly to the specific product, due to possible changes by suppliers or manufacturers; however, they must be consistent with the general and main characteristics of the article.
On the other hand, with regard to the technical sheets and respective product descriptions provided by our suppliers/manufacturers, ACQUA ZMC declines responsibility for the validity of their content.
3. DELIVERIES
. Deliveries under the responsibility of ACQUA ZMC, carried out by a transport company subcontracted for this purpose.
. Deliveries will be made on working days.
. The customer has the right, upon receipt of their order, to open the packaging to check that the product is as ordered and that it does not have any external defects.
. All orders are prepared and packaged with the utmost care by our team, therefore, whenever an order presents any anomaly, the customer must immediately mention this on the delivery note to the carrier's courier , contacting our services as soon as possible ( acqua@grupozmc.com ). Failure to do so will make it impossible for us to determine any liability on the part of the respective transport company, exempting it from any refunds or compensation, leaving the burden of any loss to the customer.
If you are able to do so, we ask that you take a photograph of the anomaly, as well as the loading guide that the courier takes with him to reinforce the claim.
If the product you receive is not the one you actually ordered or has visible defects, ACQUA ZMC advises you to refuse delivery and return the product to the carrier, who will take care of the return. You will then be contacted by our services to provide you with the necessary clarifications.
4. PRICES
All prices shown are subject to VAT at the legal rate in force.
Depending on the region from which the order is placed, orders may be subject to shipping costs, which will be calculated automatically and displayed during the purchase process.
ACQUA ZMC reserves the right to modify prices at any time. However, it will always try to apply the current rates that were indicated on the Website at the time you place your order.
5. PAYMENT CONDITIONS
The respective payments can be made as follows:
- Bank Transfer - If you choose to pay by bank transfer, you can send a copy of the transfer to our services ( acqua@grupozmc.com ) to speed up and facilitate the process. Please note that in this case, your order will only be sent after we have received and identified your payment.
- Multibanco reference via ATM or internet – In this method, you do not need to send any proof of payment. The amount will be available at the time of payment, allowing immediate dispatch of your order.
- Cash on Delivery - If you prefer to pay on delivery, you can do so in cash or by cheque (maximum €250) to the courier. This service will have an additional charge that will be communicated to you at the time you make your purchase.
- Paypal – If this is the most suitable option for you, when you select this method, you will be redirected to the Paypal page so that you can make your payment comfortably. In this situation, you will also be subject to an increase (3% of the total amount) associated with the financial costs applied by this platform.
In all cases, after your request is entered into our system, it will be processed and you will be sent an electronic message confirming it.
6. WARRANTY
If the product presents any anomaly/fault, ACQUA ZMC will repair or replace it within the warranty period defined by the respective manufacturer.
The warranty does not apply to the repair of problems resulting from a cause external to the item in question (for example: accident, shock, lightning, power outage, etc.), from use or installation not in accordance with the manufacturer's specifications, from use that is detrimental to its good conservation, from commercial or collective use, from the use of unsuitable peripherals, accessories or consumables, as well as from showing signs of mistreatment.
The transportation costs inherent to the entire repair process will be borne by the customer, as well as any damage caused by transportation outside the original packaging.
The articles sold by ACQUA ZMC are covered by the legal guarantee regime. Please take into account:
- ACQUA ZMC is a Distributor, it does not manufacture the items it sells;
- For all products, after 2 years of purchase, the warranty process may have to be handled directly between the Customer and the Manufacturer;
- If you have any difficulty using a product, first make sure that you are following all the instructions contained in the Manufacturer's Instruction Manuals. If you are unable to identify the problem, please contact our technical department ( acqua@grupozmc.com ) or the manufacturer directly.
- ACQUA ZMC is committed to doing its best to ensure that your product is exchanged as quickly as possible, but the Customer must bear in mind that the process does not depend exclusively on our company, as the Manufacturers are an active part of this process.
In the case of an item that is discontinued, the item may be exchanged for an equivalent or superior product to the one initially purchased. However, this exchange is the sole responsibility of the supplier/manufacturer. A credit note may also be issued so that the customer can later purchase another item(s).
If any changes have been made to the original product, your warranty will automatically be invalid.
In all cases, whenever an item is received for repair and no anomaly/fault is detected, or if this was caused by incorrect use, a fee may be charged to cover logistical costs.
The deadline for collecting equipment for repair is 30 days after the document is registered, otherwise, the material is considered abandoned under the terms of art. 1267/1a of the Civil Code, meaning that ACQUA ZMC is no longer responsible for the care of the equipment.
From the moment it is considered abandoned, the customer is obliged to pay, as a penalty clause, the amount of 2.5 Euros for each day of delay in collection.
After 3 years from the date of the respective document and, under article 1299 of the Civil Code, the material will become the property of ACQUA ZMC by way of adverse possession.
In the event of debts, ACQUA has the right to retain all material in its facilities until the debt is fully paid off.

7. RETURNS
Regarding possible returns, for purchases made online, Portuguese law establishes a period of 14 days (cooling off period) for the consumer after the invoice date, during which he/she may return the item(s) without having to indicate a specific reason. However, this does not imply that the item(s) may only be returned after written approval by ACQUA ZMC.
Also in accordance with Portuguese law, return postage costs are the responsibility of the consumer, and any shipping costs charged for the initial shipment of the order are not subject to refund. We also draw your attention to the fact that if the consumer has benefited from free shipping, the same shipping costs initially offered will be subject to a charge in accordance with our current price list.
To start a return process, the customer must go to our returns page, accessing it at the bottom of our website page.
For purchases or collection of items made at our physical facilities, there is no obligation under Portuguese law for the selling company to return an item if it is in compliance. In these situations, ACQUA ZMC only undertakes to accept exchanges/returns when a product presents a manufacturing defect.
Only after receiving the item(s) to be returned at our facilities and verifying that they are in good condition will ACQUA ZMC proceed with the respective compensation or possible refund of the amount in question through the original payment method.
The right of return can only be accepted for products in their original condition and complete (packaging, accessories, manual, etc.) and in good condition. Products returned incomplete, damaged or used by the customer cannot be accepted. It will also be necessary to present the corresponding purchase invoice for the return to be processed.
In all situations, ACQUA ZMC is not responsible for faults or damage caused by accident, negligence or misuse of the product.
8. SECURITY
The information that the customer provides on our Website is essential for processing the order, establishing invoices and warranty contracts. Without this information, the order will be automatically cancelled.
By writing on our Website, the customer undertakes to provide us with sincere and truthful information. Communicating false information is contrary to these general terms and conditions, as well as the terms and conditions of use that appear on our Website.
ACQUA ZMC assumes full responsibility for the confidentiality of data provided by its customers, committing to storing it in a safe location without access by third parties.
